The Manas POSH Compliance Platform is operated by Manas Center for Mental Wellness and Counselling (“Manas”, “we”, “us”). This policy explains how we collect, use and protect personal data in connection with the POSH compliance services provided through this platform and our POSH web pages. It is aligned with the Digital Personal Data Protection Act, 2023 (DPDP) and the confidentiality requirements of the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 (the “POSH Act”).
1. Data we collect
- Account data: the name, email, mobile number and login credentials of the person who registers on behalf of an organization, and a record of their acceptance of our terms.
- Organization data: company name, sector, employee headcount, office locations and logo.
- Internal Committee data: the name, designation, email, phone, gender and role of the members you nominate to your Internal Committee.
- Complaint data (sensitive): information submitted through the confidential complaint channel, which may include the identity of the complainant, the person complained against and the details of the incident.
- Enquiry data: when you use the committee check, ask for a quotation or book a call on our POSH pages: your name, company, work email, phone (if given), city (if given), headcount, number of offices, your answers to the check, the time you picked for a call, and your consent.
- Usage and technical data: log data needed to operate and secure the platform. For abuse prevention we store a one-way hash of your IP address, not the address itself.
2. Why we use it
We use this data only to provide the POSH compliance services you have engaged us for: generating your compliance documents, constituting and managing your Internal Committee, operating the confidential complaint channel and case records, delivering training, preparing statutory reports, and administering your subscription and invoicing.
We use enquiry data to send you what you asked for (your check report, your quotation or your call confirmation), to call you at the time you booked, and to send up to two follow-up emails after the committee check. Every follow-up email has a one-click unsubscribe link, and marking you as contacted stops them.
3. Consent and lawful basis
We process personal data on the basis of your consent and to perform the services requested. Internal Committee members’ details are provided to us by the organization for the specific, lawful purpose of constituting the committee under the POSH Act. You can withdraw consent at any time; this does not affect processing already done.
4. Confidentiality of complaint data
Complaint information is treated as strictly confidential in accordance with Section 16 of the POSH Act. Access is restricted to the members of the relevant Internal Committee, the empaneled external member, and authorized Manas personnel who support the committee. It is never published or disclosed to unauthorized persons, and it is never used for marketing.
5. Sharing
We do not sell personal data. We share it only: (a) with the members of your Internal Committee and the external member, to the extent necessary for them to perform their statutory role; and (b) with service providers who host our platform, send our email and process payments, under appropriate safeguards. The current list is on our POSH Trust & Privacy page. We may disclose data where required by law.
6. Retention
We retain compliance records for as long as required to meet the record-keeping and audit obligations under the POSH Act and applicable law, and then delete or anonymize them. We keep enquiry records while they are needed to respond to you and to follow up as described above; you can ask us to delete them at any time.
7. Your rights
Subject to applicable law, you may request access to, correction of, or erasure of your personal data, and may withdraw consent. To exercise these rights, contact our Grievance Officer below. Requests relating to complaint data are handled consistently with the confidentiality and record-keeping duties of the Internal Committee under the POSH Act.
8. Security
We apply technical and organizational measures appropriate to the sensitivity of the data, including access controls, logging and an audit trail. No method of transmission or storage is completely secure, and we continually work to strengthen our safeguards.
9. Cookies
The platform uses only the cookies necessary to keep you signed in and to operate it securely. Our public web pages may use analytics and advertising cookies only in line with the choices you make in our cookie banner.
