The Sexual Harassment of Women at Workplace Act, 2013 requires every such workplace to run an Internal Committee. That committee is not valid unless it includes one external member from outside your organisation. Miss it, and your compliance does not stand.

POSH compliance, in plain terms

Does my company need a POSH external member?
Yes, if you have 10 or more employees at any workplace. The POSH Act requires an Internal Committee, and Section 4(2)(c) requires that committee to include one external member from outside your organisation. A committee without an external member is not valid, however many internal members it has.
Who can be a POSH external member?
The law asks for a person from a non-governmental organisation committed to the cause of women, or a person familiar with the issues of sexual harassment. Dr. Priya qualifies on both counts, as a psychologist with organisational expertise and as President of Indradhanush Welfare Foundation, a registered NGO.
Can the external member and the training be done online?
Yes. Committee meetings, inquiry participation, policy setup and employee training are all delivered online, so we work with companies anywhere in India. In-person sessions in Bhopal are available on request.
What is Section 4(2)(c) of the POSH Act?
It is the clause that requires one member of the Internal Committee to come from an NGO or association committed to the cause of women, or to be a person familiar with issues relating to sexual harassment. It exists to bring a neutral, outside perspective to every inquiry.
What does POSH compliance actually involve?
Four things. A validly constituted Internal Committee, a written POSH policy that is displayed and communicated, awareness training for employees and managers, and an annual report filed under Section 21. Manas can set up and support all four.

Who sees a harassment complaint?
